KITCHEN MASTERS - SACRAMENTO: OFFICIAL RULES & REGULATIONS
1. BINDING AGREEMENT & ELIGIBILITY By registering, purchasing an entry pass, paying any evaluation or re-entry fee, or submitting materials to Kitchen Masters - Sacramento (hereinafter referred to as the "Competition," "Management," or "Organizers"), the individual participant (hereinafter referred to as the "Participant") agrees to be fully and unconditionally bound by these Official Rules & Regulations. Failure to comply with any provision herein will result in immediate disqualification and forfeiture of all rights without recourse.
2. ABSOLUTE NO-REFUND POLICY All fees paid to the Organizers—including but not limited to initial entry fees, registration tier upgrades, Level 1 through Level 4 re-submission/evaluation fees, and processing charges—are 100% NON-REFUNDABLE AND FINAL under all circumstances.

Refunds will NOT be issued for any reason, including but not limited to: Participant disqualification, voluntary withdrawal, technical failure, dissatisfaction with judge evaluations/scorecards, failure to advance through competition rounds, or event rescheduling, modification, or cancellation.

Any payment chargebacks, payment disputes, or fraudulent reverse-transactions initiated by the Participant or their financial institution will be treated as a material breach of contract, resulting in immediate disqualification, permanent blacklisting, and referral to collections plus legal costs.
3. COMPLETE INTELLECTUAL PROPERTY ASSIGNMENT & WORK-MADE-FOR-HIRE The Participant acknowledges and agrees that all submissions, media, and creative assets are deemed a "work-made-for-hire" for the Organizers.

Included Submission Data: This includes, but is not limited to, all written text, recipes, culinary techniques, ingredient lists, photographs, video submissions, audio recordings, personal notes, and visual media ("Submission Data"). To the extent any Submission Data does not qualify as a work-made-for-hire, the Participant hereby irrevocably assigns and transfers all global rights, titles, copyrights, trade secrets, and interests to the Organizers in perpetuity.

Commercial Exploitation & Recipe Book Sales: The Organizers retain the absolute, perpetual, sublicensable, and worldwide right to edit, modify, publish, broadcast, distribute, license, and monetize the Submission Data across all platforms. This explicitly includes compiling, publishing, printing, and selling commercial recipe books, digital courses, docuseries, and broadcast media featuring the Participant’s recipes, techniques, name, voice, and visual image, without obligation of royalties, attribution, financial compensation, or prior approval.

Waiver of Moral Rights: The Participant permanently waives all "moral rights" or claims of authorial ownership over all submitted texts and media.
4. STRICT NON-DISCLOSURE AGREEMENT (NDA) & LIQUIDATED DAMAGES To preserve the commercial integrity, judging standards, and broadcast elements of the Competition:

The Participant agrees NOT to share, publish, stream, leak, or discuss any aspect of their submission, judging scores, evaluation rubrics, internal communications, judge feedback, video footage, or competition mechanics with third parties, other participants, or the public (including all social media platforms, blogs, and podcasts).

Confidentiality remains in full force in perpetuity unless released in writing by the Organizers.

Liquidated Damages: The Participant agrees that any breach of this NDA causes irreparable harm to the Organizers. Any unauthorized leak or disclosure will result in immediate disqualification, forfeiture of all placement, and liability for liquidated damages in the amount of $100,000 per violation, plus full reimbursement of legal fees incurred by the Organizers to enforce this provision.
5. UNLIMITED RIGHT TO DISQUALIFY & REMOVE The Organizers reserve the absolute, sole, and unquestionable right to disqualify, suspend, or permanently remove any Participant from the Competition at any time and for any reason, without prior notice. Grounds for immediate removal include, but are not limited to: violation of these rules, breach of confidentiality, unsportsmanlike conduct, harassment of judges or staff, submission of plagiarized/stolen recipes, or any action deemed detrimental to the reputation of Kitchen Masters - Sacramento. Disqualification results in immediate forfeiture of all competition status without refund.
6. INDEMNIFICATION & HOLD HARMLESS The Participant agrees to defend, indemnify, and hold harmless Kitchen Masters - Sacramento, its parent entities, officers, directors, judges, sponsors, video production teams, and affiliates from and against any and all third-party claims, demands, liabilities, losses, damages, costs, and expenses (including attorney’s fees) arising out of or related to: (a) the Participant’s breach of any warranty or rule; (b) any claim that the Participant’s submitted recipe or media infringes upon the copyright, trademark, or trade secret of any third party; or (c) any personal injury or property damage sustained during participation.
7. TYPOGRAPHICAL ERRORS, OMISSIONS & SYSTEM FAILURES The Organizers, judges, and technical partners are not responsible or liable for typographical errors, misprints, administrative oversights, platform downtime, lost/corrupted digital uploads, email delivery failures, or miscalculated scorecards across any competition medium. The Organizers reserve the right to correct any clerical errors at any time.
8. ABSOLUTE WAIVER OF LIABILITY & COVENANT NOT TO SUE By completing registration, the Participant knowingly assumes all physical, financial, and legal risks associated with a high-stakes culinary tournament.

Complete Release: The Participant unconditionally and forever releases, waives, and discharges Kitchen Masters - Sacramento, its parent companies, owners, judges, venue hosts, and partners from any and all legal claims, demands, causes of action, liabilities, or losses—whether caused by negligence or otherwise.

Covenant Not to Sue: The Participant explicitly covenants and agrees that they will NEVER file, initiate, maintain, or join any lawsuit, class action, administrative claim, or legal proceeding against the Organizers or associated parties regarding any aspect of the Competition, including intellectual property usage, judging decisions, disqualifications, recipe book publications, or injuries.
